BOK (Be Okay) Private Membership Association ("The Association") Membership Agreement
This private contractual agreement is entered into by and between BOK (Be Okay) Private Membership Association (PMA) (hereinafter "we" "our" "The Association") and a Member (hereinafter "I," "you," "your"), collectively "Members".
MISSION
The mission of the farm is to grow healthy produce without dangerous ingredients (like GMOs, agricultural chemicals, etc.) imposed by certain multi-letter agencies. We declare the freedom to choose for ourselves the types of products, services and methods that we think best for maintaining a healthy farm environment. The purpose of The Association is to facilitate the sharing of the bounty and blessings of the farm with Members seeking the same quality foods without the imposed burden from certain agencies.
It is not The Association's intent to educate on the important differences between public and private activities; rather we encourage Members to research these topics further. Suffice it to say that there are meaningful differences that must be fleshed out in this Agreement. The following declarations are in accordance with conducting our relationship in the private.
IT IS HEREBY Declared that we are exercising our right of "freedom of association" as guaranteed by the First and Fourteenth Amendments of the U.S. Constitution and equivalent provisions of the various State Constitutions. This means that our association activities are restricted to the private domain only.
MEMORANDUM OF UNDERSTANDING
By joining The Association, Members agree to comply with and honor the Membership Agreement;
THEREFORE, I agree as follows:
I understand that Members are to act in good faith, without malice or pretense; to only represent themselves as a natural man or woman, without titles, and are not acting as a representative of any federal, state or local government or agency.
I understand that acceptance as a Member of The Association entitles me to participate in the benefit and bounty of the farm; but does not create an obligation on the part of The Association to provide any specific good or service. I further understand that becoming a member does not entitle me to participate in a specific produce, harvest, festival or other activity and I recognize that any such bounty or harvest is available only by the grace of God.
Further, I understand that The Association is not acting in the capacity as a licensed wholesaler, retailer or provider and that no wholesaler/retailer-customer relationship exists; rather only a contract member-member Association relationship exists. Additionally, I have freely chosen to change my legal status as a consumer/customer to that of a private member of The Association.
I agree to join The Association, a private-membership association under common law, and to abide by the terms and conditions set forth in this agreement. I acknowledge that I may not access this or any member benefit if I am not in accord with the provisions of this agreement.
The activities I engage within The Association are a private matter that I refuse to share with any non-member of The Association. I enter into this agreement of my own free will or on behalf of my dependent(s) without any pressure or promise of product.
As a member, I embrace the mission of The Association and I realize that no product testing is foolproof. I agree to use sound judgement and follow best practices while dealing with any farm product.
The Association only collects basic membership information (name, email and phone) in order to facilitate private activities and will not sell or surrender membership information. The website stores certain information on your computing device, known as cookies, in order to facilitate a conversation. The minimum number of such cookies are employed to make the site usable, no more.
The Association may, at certain intervals, publish a newsletter about life on the farm. The newsletter may appear on The Association's website, the Member's email in box, or both.
In addition, I understand that since The Association is protected by the First and Fourteenth Amendments of the U.S. Constitution, it is outside the jurisdiction and authority of Federal and State Agencies and Authorities concerning any and all complaints or grievances against The Association, any Trustee, other Member or staff persons. Because of the privacy and security of membership records maintained within The Association, which have been held to be inviolate by the U.S. Supreme Court, the undersigned member waives complaint process. Complaints or grievances will be settled internally by binding arbitration by a mutually agreed Association designee, committee, or tribunal and "legal" settlement is waived by the aggrieved Member as necessary for the benefit of The Association and its body of Members.
I understand that I can withdraw from this agreement and cancel my membership in The Association at any time. Further, I understand that my membership can and will be revoked if I engage in abusive, violent, menacing, destructive or harassing behavior towards The Association or any of its Members.
The benefits of membership vest in you and are non-transferrable. Sharing in any such bounty or harvest is for your personal use and you agree that you will not share, lend, resell, transfer or in any other way dispose of your membership benefits other than by cancellation. Immediate family members are covered by your personal use and are bound by the same terms.
These web pages consist of the entire agreement for membership in The Association and supersedes any previous agreement.
We reserve the right to change or update this agreement as we see fit at any time.
